Industries Exempted from 'NOC' (A List of Nonpolluting Industries having no pollution potential)

A list of 100 small and cottage Industries having no pollution potential was published under the circular of the Gujarat Pollution Control Board No. P-693 (SEZ)/32831 dated 28-10-2002. These industries are exempted from obtaining NOC (No Objection Certificate) from the Board for establishing such industries and for conversion of land to 'non agricultural' use. However it is necessary to obtain prior consent from the Board for those units which discharge wastewaters, or washing of reactors or equipment or from toilets, etc. or emit smoke from process(es) or chimney or dispose of solid wastes or hazardous wastes. Guidelines for Establishing Small and Cottage Industries

  • It is not necessary for the Taluka Development Officers, District Development Officers, Deputy Collectors and District Collectors to seek opinions of the Board for conversion of the land to 'Non Agricultural' (NA) use.

  • It is not necessary for an industry to obtain NO OBJECTION CERTIFICATE (NOC) from the Board for getting electrical connections from Gujarat Electricity Board, Ahmedabad Electricity Co. or Surat Electricity Co.

  • It is not necessary for an industry to obtain NOC from the Board for the purposes of subsidy, registration as small scale unit at the District Industrial Centres and to the Sales Tax Department.

  • It is not necessary to obtain NOC from the Board for the purposes of getting loans or financial assistance from the financial institutions.

  • For the listed 100 small and cottage industries the Revenue Officers shall examine the below mentioned conditions for passing orders for conversion to 'Non Agriculture' use.

    (i) The location of these units shall be 500 metres away from residential areas.

    (ii) It shall be 50 metres away from the control line of the National Highway/State Highway/Major District Road, etc. as decided by the Roads and Buildings Department of the Government of Gujarat.

    (iii) It shall be also 50 metres away from the control line of the Indian Railways.

    (iv) It shall be 500 metres away from the water resources like rivers, streams (culverts), ponds, tanks, reservoirs, canals, etc.

    (v) Such units shall have to develop a green belt 5 metre wide around their units and this condition shall be included while passing order for 'Non Agriculture' use.
